1. Acceptance of Terms
By creating an account, accessing, or using the OctoHex platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you ("User", "you") and OctoHex ("Company", "we", "us"). By checking the attestation box on each order submission, you reaffirm your acceptance of these Terms for that specific transaction.
2. Eligibility & Professional Status
To use OctoHex, you must:
- Be at least 18 years of age
- Be a registered business — a licensed garage, workshop, automotive dealer, or professional ECU technician
- Have the legal right to modify the vehicle for which you are submitting an order, or hold written authorization from the registered vehicle owner
- Comply with all applicable laws and regulations in your country regarding vehicle modification, ECU programming, and immobilizer systems
- Not be located in a jurisdiction where the Service or vehicle ECU modification is prohibited
We reserve the right to request proof of professional status at any time. Accounts that cannot demonstrate eligibility will be suspended without refund.
3. The Service
OctoHex provides a cloud-based ECU immobilizer bypass processing service. You upload a binary ECU file, we apply cryptographic pattern matching, and return a modified file for use by your workshop.
Service Availability
We aim to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance, infrastructure events, or third-party payment provider outages may cause temporary unavailability. We will not be liable for losses resulting from service interruptions.
Supported Profiles
The Service supports a defined set of ECU profiles (listed in the platform). We do not guarantee that all vehicles or ECU variants within a listed brand will be successfully processed. If processing fails, you will not be charged.
No Guarantee of Result
While we apply industry-standard techniques, ECU binary modification carries inherent risks. We do not guarantee that every processed file will function correctly in every vehicle. You are responsible for validating results before deploying them.
4. Your Obligations
You agree to:
- Upload only files you are authorized to modify. Uploading files from vehicles you do not own or have no written authorization for is a violation of these Terms and may constitute a criminal offence.
- Provide accurate and truthful information at registration and on each order
- Keep your login credentials confidential and immediately notify us of unauthorized account access
- Not attempt to reverse-engineer, decompile, or extract intellectual property from the Service or its outputs
- Not use the Service for any illegal purpose, including theft facilitation, unauthorized vehicle access, or insurance fraud
- Not share your account with third parties or resell the Service without express written consent
- Not attempt to circumvent rate limits, authentication, or any security measure
- Comply with all applicable laws — including vehicle modification laws, road worthiness requirements, and anti-theft legislation in your jurisdiction
5. Payment & Billing
Pricing
The Service operates on a per-order billing model. The current price is €19.99 per ECU processing order. Prices are displayed before payment and are inclusive of all fees.
Payment
Payment must be completed before processing begins. We accept:
- PayPal (sandbox / live)
- Cryptocurrency via NOWPayments (Bitcoin, Ethereum, USDT, and 100+ coins)
All prices are in Euros (€). Currency conversion is handled by the respective payment provider.
Refund Policy
- If processing fails due to an error on our side (engine failure, unsupported file format), you will receive a full refund or a free retry at your choice.
- If processing succeeds and you download the output file, no refund is issued.
- If you upload an incorrect or incompatible file, no refund is issued as the processing attempt was completed.
- Refund requests must be submitted within 7 days of the order via support@octohex.com with your order ID.
6. Intellectual Property
All software, algorithms, ECU profiles, pattern libraries, and platform code are the exclusive intellectual property of OctoHex and are protected by copyright and trade secret law. You are granted a limited, non-exclusive, non-transferable licence to use the Service outputs solely for your own professional automotive workshop activities.
You may not copy, distribute, resell, sublicence, or create derivative works from any part of the Service or its outputs beyond their intended use.
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" without warranty of any kind, express or implied
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or vehicle damage
- Our total aggregate liability for any claim arising from use of the Service shall not exceed the total amount you paid to us in the 3 months preceding the claim
- We are not responsible for misuse of processed ECU files, illegal vehicle modifications, or any consequences arising from deployment of output files
Some jurisdictions do not allow limitation of liability for personal injury or consequential damages, so some of these limitations may not apply to you.
8. Termination
We reserve the right to suspend or permanently terminate your account, without prior notice, if:
- You breach any provision of these Terms
- We reasonably suspect fraudulent, abusive, or illegal activity
- You fail to pay for orders
- We are required to do so by law or legal order
Upon termination, your right to access the Service ceases immediately. Order audit records will be retained as required by law. You may request account closure at any time by emailing support@octohex.com.
9. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify registered users by email and update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
10. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the European Union and the jurisdiction in which OctoHex is registered. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
